When making a necrotising fasciitis claim, it is necessary to establish that the breach of duty caused a patient to suffer damage. In this article we explore various issues that will be taken into consideration.
Condition and prognosis reports
During the course of your necrotising fasciitis claim, a medical expert will be asked to write two reports on your case. One report will deal with breach of duty, which will explore whether or not there was a substandard level of medical care. The other report will deal with condition and prognosis, exploring how your injuries have affected your life, and how your injuries will continue to affect your life in the future.
In order to complete the condition and prognosis report, the medical expert will need to speak to you in person. During this meeting, you may be asked about the following issues:
1. Employment
If your physical and/or psychological injuries have rendered you unable to continue with employment, or have severely impacted your capacity on the labour market, this will be taken into consideration. Your solicitor will also calculate how this has affected you financially in the Schedule of Loss, a document which details your actual financial loss.
2. Domestic situation
The way in which your domestic situation has been damaged will be explored. This includes a range of issues, such as whether or not you are able to move around your own home, whether adaptations to the house have had to be made, and whether you are able to undertake any domestic chores.
3. Social life
If your physical and/or psychological injuries have affected your ability to undertake social activities, this will be described within the report. This might include your ability to participate in hobbies, visit friends and family and generalise socialise.
4. Relationships
Necrotising fasciitis can have a detrimental impact upon personal relationships – this might be with a husband/wife/partner, with family and friends, and with children. If this is something that has affected you – for example, you no longer have a sexual relationship with your partner – this will be highlighted.
